Welcome to LightStart (hereinafter referred to as "this website", "we" or "LightStart"). This website is operated by the LightStart Creative Technology Lighting team. The following terms (hereinafter referred to as "these Terms") govern your use of the LightStart website (including all subpages, mobile-optimized versions, and related services). Please read all terms carefully before using this website or purchasing any products.

Important Note: If you are a consumer residing in the EU, UK, Switzerland, or Norway, nothing in these Terms will restrict your legal rights under applicable local consumer protection laws (such as the 14-day withdrawal right, 2-year statutory warranty, etc.). In the event of any conflict between these Terms and mandatory laws, the latter shall prevail.

I. Acceptance of Terms

1.1 By accessing this website, browsing products, registering an account, or placing an order, you agree to abide by these Terms and our Privacy Policy, Refund Policy, and Shipping Terms, which are incorporated herein by reference.

1.2 If you do not agree to any part of these Terms, please immediately stop using this website.

1.3 We reserve the right to modify these Terms at any time. The revised terms will be published on this page, indicating the "Last Updated" date. For significant changes, we may notify you via email or website pop-ups. Your continued use of this website constitutes acceptance of the updated terms.

II. Eligibility and Account Registration

2.1 You must be 18 years of age or older, or of legal age in your country, to purchase products from LightStart. Users under the age of 18 may only use this website with the assistance of a parent or guardian.

2.2 You do not need to register an account to browse products, but you will need to provide a valid email address, shipping address, and payment information when placing an order. You can choose to create an account (using an email address and password) to view your order history, save addresses, and preferences.

2.3 You are responsible for keeping your account information (including your password) confidential and for all activities occurring under your account. If you discover any unauthorized use of your account, please notify us immediately: onlinesupport@lisahartke.com.

2.4 We reserve the right to refuse any user registration, close accounts, or cancel orders, especially in the event of fraud, abuse, or violation of these terms. III. Product Information and Availability

3.1 Product Description: We strive to ensure the accuracy of information on our product pages (including images, videos, technical parameters, color temperature range, control methods, etc.). However, due to differences in monitor color display, the actual product color may slightly differ from the screen display; this does not constitute a product defect.

3.2 Features of Creative Technology Lights: LightStart products integrate software, firmware, and hardware. Some functions may require an internet connection and software updates. We will make every effort to pre-install the latest stable firmware before shipping.

3.3 Availability: Product inventory is subject to change. If a product is out of stock after you place your order, we will notify you within 2 business days and offer: ① Waiting for restocking (estimated time), ② Replacing with a similar product, ③ Order cancellation and a full refund.

3.4 Customized Products: If you request personalized customization of the lighting fixtures (such as engraving, special patterns), such customized products will not be eligible for the 14-day no-reason return policy once production begins (see refund policy). However, customized products are still covered by the statutory warranty.

IV. Order and Contract Formation

4.1 Order Submission: After adding the product to your cart and completing the payment process, you will receive an automatically sent "Order Confirmation Email." This email only indicates that we have received your order request and does not constitute acceptance of the order.

4.2 Contract Formation: The purchase contract is formed when we send you a "Shipping Confirmation Email" (i.e., notifying you that the product has been shipped from the warehouse). Before this, we reserve the right to cancel the order and provide a full refund due to reasons such as inventory issues, pricing errors, or payment risks.

4.3 Price and Currency: All product prices are displayed in Euros (€) and include applicable Value Added Tax (VAT) and import duties (DDP mode). We adopt a zero shipping and zero duty policy; the amount you pay is the final price.

4.4 Pricing Errors: Despite our best efforts, obvious pricing errors may occur (e.g., a lamp priced at €199 is incorrectly displayed as €19). In this case, we are not obligated to ship at the incorrect price. We will notify you and allow you to continue purchasing at the correct price or cancel the order. V. Payment Methods

5.1 We accept the following payment methods (subject to the actual list on the checkout page).

5.2 All payments are processed through PCI-DSS compliant payment service providers. We do not store your complete credit card information.

5.3 If your payment is rejected due to insufficient funds, bank refusal, or payment service provider risk assessment, we will not process the order and will notify you to change the payment method.

VI. Shipping and Delivery

6.1 We provide standard shipping to Europe (EU, UK, Switzerland, Norway), with all orders free of charge and customs duties (DDP). The specific shipping time is 10-15 business days (from the date of shipment). Please refer to our Shipping Terms for detailed terms.

6.2 Transfer of Ownership: Ownership and risk of loss transfer to you when the product is signed for at your designated delivery address. For damage occurring during transportation, we promise to replace or refund you according to our refund policy.

6.3 If the package is returned due to an incorrect address you provided, we may require you to bear the cost of reshipping (but customs duties will still be waived).

VII. Refunds and Returns For detailed regulations regarding your legal right of withdrawal, handling of quality defects, warranty policies, etc., please refer to the Refund Policy. A brief summary is as follows:

14-Day No-Reason Return Right: You may notify us of a return within 14 days of receiving the product (you bear the return shipping costs, and the product must be in its original packaging and reasonably inspected condition).

Quality Defects or Transportation Damage: We bear all return shipping costs and customs duties, providing free replacements or full refunds.

2-Year Statutory Warranty: For non-human-caused malfunctions occurring under normal use, we provide free repair or replacement.

VIII. Intellectual Property

8.1 All content on the LightStart website, including but not limited to text, graphics, logos, icons, images, videos, audio, software code, product designs, and user interfaces, is the property of LightStart or its licensors and is protected by EU and international copyright, trademark, and patent laws.

8.2 You may not: copy, distribute, modify, reverse engineer, republish, or scrape any content from this website for commercial purposes; or remove any copyright or trademark notices.

8.3 LightStart grants you a limited, revocable, non-exclusive license to access and browse the website and purchase products for personal, non-commercial purposes.

8.4 Any feedback, ideas, or suggestions you submit to LightStart (e.g., via email or social media) will be considered non-confidential information, and we may use, modify, and incorporate them into our products free of charge without paying you compensation.

IX. User Conduct Guidelines
You agree that when using this website you will not:

violate any applicable laws or regulations;

infringe on the intellectual property rights or privacy rights of others;

upload materials containing viruses, malicious code, or any material designed to disrupt the website's functionality;

Violation of the above guidelines may result in immediate termination of your account, and we may report it to law enforcement agencies.

11. Disclaimer and Limitation of Liability

11.1 To the maximum extent permitted by applicable law, LightStart provides the website and services on an "as is" and "as available" basis without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation of the website.

11.2 LightStart shall not be liable for:

delay or failure to perform due to events beyond our reasonable control (such as war, strikes, natural disasters, government actions, power or internet outages);

damage or injury resulting from your failure to use the light fixture in accordance with the product instructions or safety warnings;

any indirect losses, loss of profits, loss of data, or loss of goodwill, even if we have been advised of such possibilities.

11.3 For direct losses, LightStart's total liability for damages arising from your purchase of the product shall not exceed the amount you paid for that product (unless otherwise mandated by law).

11.4 Nothing in these Terms shall exclude or limit our liability for death or personal injury (caused by our negligence), fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

XII. Indemnification You agree to indemnify and hold harmless us (LightStart and its employees, directors, and affiliates) from and against all claims, losses, liabilities, and costs (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, misuse of this website, or violation of any law.

XIII. Termination
13.1 You may terminate these Terms at any time by ceasing use of this website and closing your account (if any).

13.2 We reserve the right to suspend or terminate your access to this website if we believe you have breached these Terms or engaged in harmful conduct. Even after termination, you will remain liable for any outstanding payment obligations for orders placed.

XIV. Applicable Law and Dispute Resolution

14.1 For consumers residing in the European Economic Area (EEA), the United Kingdom, Switzerland, or Norway, these Terms and Conditions, and your relationship with LightStart, shall be governed by the laws of the country of your habitual residence, in particular the mandatory provisions of those countries concerning consumer protection. For non-consumers (such as those making commercial purchases), Dutch law shall apply (as our European headquarters are located in Amsterdam, Netherlands), without regard to conflict of laws principles.

14.2 Dispute Resolution:

If you are an EU consumer and are dissatisfied with our solution, you may resort to the EU Online Dispute Resolution Platform (ODR): https://ec.europa.eu/odr. Our ODR contact email address is the same as the one mentioned above.

You may also choose to bring suit in the Small Claims Court in your place of residence. We commit to accepting the jurisdiction of the local court (provided it complies with EU consumer jurisdiction rules).

14.3 Any legal proceedings arising out of or relating to these Terms, if unable to be resolved through the foregoing methods and if you choose to bring suit in our jurisdiction (excluding consumer commercial transactions), shall be subject to the exclusive jurisdiction of the Courts of Amsterdam, Netherlands.

XV. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the parties shall endeavor to replace any invalid provision with an alternative provision that achieves the original intent to the extent permitted by law.

XVI. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Terms, constitute the entire agreement between you and LightStart regarding your use of this website and your purchase of products, superseding all prior oral or written communications.

18. Special Note: Your Legal Rights Are Unaffected

The right to free repair, replacement, or price reduction/refund for products that do not conform to the contract;

The right to withdraw your order within 14 days without giving a reason;

A 2-year statutory warranty period (in EU member states);

The right to seek recourse for manufacturing defective products.

LightStart fully supports your consumer rights. We will not deceive or restrict these rights in any way through these Terms.
